1. Scope
These Terms & Conditions apply to all contracts between Maria Sko (Mariia Skorobohatova) (“the Photographer”) and her clients for photography, creative consulting, and gift certificates. Conflicting terms of the client do not apply unless expressly agreed in writing.

2. Contract Formation
A contract is concluded when the client confirms a booking and pays the required prepayment. Payment constitutes full legal acceptance of these Terms. No signature is required.

3. Prices and Payment
Prices are agreed individually. Unless stated otherwise, 50% of the total fee is due as a non-refundable prepayment. The remaining balance must be paid no later than the day of the shoot. The Photographer may refuse to perform services if payment is not received.

4. Legal Nature of Prepayment and Consultation
The prepayment is not a reservation fee but a legally binding partial payment and promise to pay. Upon payment, the Photographer blocks the date, refuses other work, and begins preparatory and creative services.
Once consultation has been delivered — including concept, outfit, makeup, hair, and location suggestions — the prepayment is fully earned and non-refundable. This secures the Photographer’s compensation claim under §1168 ABGB.

5. Cancellation, No-Show and Client Default
If the client cancels, does not appear, arrives too late to reasonably perform the shoot, or cannot perform for any reason on their side, the prepayment is forfeited and the full agreed amount remains payable. No refunds or credits apply unless explicitly confirmed in writing by the Photographer.

6. Rescheduling
Rescheduling is a goodwill gesture, not a right. One reschedule may be granted if requested at least 48 hours in advance and rebooked within 30 days. Otherwise, the prepayment expires.

7. Shooting Time and Delays
Shooting time begins at the agreed start time. Client delays reduce the available shooting time accordingly. Time spent changing outfits, makeup, or locations is included in the booked shooting time.

8. Locations, Studios and Additional Costs
Shoots may take place outdoors, in studios, or at other locations in Vienna. Other locations may be booked upon request.
If a studio is used, it is booked on a full prepayment basis and billed separately under the studio’s own terms. The Photographer handles the booking process.
If a location requires admission tickets or transport, the client agrees to cover these costs for both the client and the Photographer.

9. Artistic Style and Editing
By booking, the client confirms familiarity with the Photographer’s style and agrees to the Photographer’s artistic interpretation and editing. Editing decisions are made at the Photographer’s discretion and form part of her corporate style.

10. RAW Files and Copyright
RAW files are not included in any basic offer and may only be purchased by separate written agreement.
All photographs remain the intellectual property of the Photographer. Private usage rights are included unless otherwise stated. Any commercial use without written permission or contract constitutes a copyright violation.

11. Delivery and Storage
High-resolution digital images are delivered via a private online gallery. Galleries remain available for 3 months unless otherwise agreed. After this period, files may be permanently deleted.

12. Gift Certificates (Vouchers)
Vouchers purchased remotely are subject to a 14-day statutory right of withdrawal under Austrian law (FAGG), provided the voucher has not been redeemed or transferred. Withdrawal must be declared in writing.
A buyer who purchased a voucher as a gift may use it themselves only if this is communicated in writing within 14 days of purchase. After that, the voucher is permanently assigned to the named recipient.
After the 14-day period, vouchers are non-refundable, non-cancelable, and not redeemable for cash. They represent a claim to a service, not to money.

13. Liability
The Photographer is liable only for damages caused intentionally or by gross negligence. No liability is assumed for personal belongings, travel issues, third-party failures, or client-side problems.

14. Force Majeure
If the Photographer must cancel due to serious illness, accident, or force majeure, the client may choose between a full refund of the prepayment or rescheduling. This is the only case in which a refund applies.

15. Governing Law and Jurisdiction
Austrian law applies. Place of jurisdiction is Vienna, Austria.

16. Severability
If any provision is invalid, the remaining provisions remain in force.
